Three major causes of death in the U.S. — obesity, heart disease and lung cancer — are largely preventable, with modifiable risk factors. Our prevention and wellness care focuses on identifying personal risk factors for developing these and other diseases, and providing the assistance needed to make lifestyle choices that will reduce or prevent those risks or help manage existing conditions. The mission of the Compliance & Ethics Program at Orlando Health is to assist the organization with its commitment to conducting its business in full compliance with applicable federal and state statutes, regulations, the Code of Conduct and corporate policy. The program assists in supporting and maintaining a culture of compliance, integrity and business ethics within the organization. Further, the program aids in the prevention, detection and resolution of deviations from expected behavior, whether intentional or not. The program provides education and is a resource to consult on compliance matters. The Compliance and Ethics Program provides many benefits to Orlando Health, including: Helping to ensure that protected health information is kept secure Orlando Health’s Compliance Hotline is a simple, risk-free way for team members to report compliance concerns. The Compliance Hotline connects team members to an outside vendor who forwards the information they provide to Compliance & Ethics for investigation and resolution. Team members can remain anonymous when reporting compliance concerns. All matters reported to the Compliance Hotline are investigated thoroughly and in a timely manner. The Code of Conduct is the cornerstone of our Compliance and Ethics Program. It assists team members in maintaining Orlando Health’s high ethical standards in all business dealings and provides guidance to ensure that our organization conforms to the ethical and legal standards expected of us. The Code of Conduct provides guidance to team members on important topics such as legal compliance, workplace conduct and integrity, confidentiality, record keeping, conflicts of interest, business relationships and the protection of assets. This rule represents what would be considered the best practices by other industries but is specifically tailored to healthcare. Some of the requirements in the rule are already being done to a degree. For example, the rule requires security training for employees and the use of authentication mechanisms to access computers. It also requires the creation and enforcement of policies and procedures to govern the way we work. Other requirements such as the need for encrypting electronic transmissions that contain PHI and that travel outside of our network are new and will have to be addressed in order to achieve compliance. Finally, the Security Rule does not tell us what technology to use nor how to go about creating some of the policies that we will need. It does require that we determine what approach to take that will best suit our needs while still meeting the basic obligations in each area. HIPAA, the Health Insurance Portability and Accountability Act is the most comprehensive healthcare privacy legislation ever passed in the United States. All health care providers (hospitals, physicians, pharmacies, dentists, etc.), health plans and health care clearinghouses (3rd party vendors for billing, claims, etc.), must comply. HIPAA protects medical records and other individually identifiable health information whether it is on paper, in computers or communicated orally. Orlando Health must comply with HIPAA. What does the Privacy Rule require the average healthcare provider, including Orlando Health, to do? Provide information to patients about his or her privacy rights as well, as how information can be used.
