All SIMKAR luminaires are guaranteed against defects in material or workmanship for a period of one (1) year from the date of shipment to the Customer. The determination of whether any product is defective shall be made by Simkar with consideration given to the overall performance of the product. Poles are guaranteed against defects in materials and workmanship for a period of one (1) year from date of shipment. Some components such as fluorescent ballasts are covered by external manufacturers’ warranties that will apply in lieu of this warranty. No guarantee is provided for improperly stored, installed, maintained, or operated products outside the specified electrical and environmental (e.g., temperature, moisture, chemical) conditions required for normal operating parameters of the system. This warranty is void if the product is operated, with non-compatible external devices (controls, dimmers, current limiters etc.), abused, or used in a manner for which it was not intended. Simkar shall not be responsible for product failures caused by external events including but not limited to acts of God, power surges, or installation methods that do not conform or are in violation of applicable codes and instructions including those contained in the latest National Electrical Code (NEC), the Standards for Safety of Underwriters Laboratory, Inc. (UL), Standards for the American National Standards Institute (ANSI), and in Canada, The Canadian Standards Association (CSA).
