and any other websites through which Laugh Dealer makes the Services available (collectively, the “ ”), whether or not you register as a member of Laugh Dealer. If you wish to become a member and make use of the Laugh Dealer Services, please read these Terms of Use. Laugh Dealer Privacy Policy (below). If you do not accept and agree to be bound by all of the terms of this Agreement, including the Laugh Dealer Privacy Policy, do not use the Site or the Services. Please contact us with any questions regarding this Agreement. These Terms of Service, which include our Privacy Policy, govern your use of the Laugh Dealer Site. By using, visiting, or browsing the Laugh Dealer Site, you accept and agree to these Terms of Service. If you do not agree to these Terms of Service, refrain from using the Laugh Dealer Site. Laugh Dealer reserves the right, at its sole discretion, to revise the Site, Application or Services or to revise this Agreement, including the Service Fees, without notice and at any time. This includes the revising of the Service Fees. If a revision or revisions occur, we will post said revision(s) on the Site or via the Application, and/or provide notice to you of the revisions via email. The “Last Updated” date at the top of this Agreement will also be updated to the latest revision date. Upon posting of the revisions, all changes to the Agreement will be effective. If you continue to utilize or access the Site, Application or Services, this will serve as your acceptance and adoption of the revised terms of the Agreement. In addition, in the event the revised Agreement affects existing members by decreasing rights and/or increasing responsibilities, prior notice will be transmitted to existing members in advance of any changes taking effect. Any revised Agreement deemed unacceptable to you results in your only option being to stop using the Site, Application and Services. Not deactivating your Laugh Dealer account serves as your acceptance of any revision(s). The Site, Services, and Application are intended solely for persons who are 18 years of age or older. It is explicitly prohibited for anyone under the age of 18 to access or use the Site, Services, or Application. Accessing and/or using the Site, Services, or Application constitutes as an admission that you are 18 or older. The use and/or access of certain areas and features of the Laugh Dealer Platform may be subject to separate policies, standards or guidelines. It may require that you accept additional terms and conditions. If there is a conflict between these Terms and terms and conditions applicable to a specific area or feature of the Laugh Dealer Platform, the latter terms and conditions will take precedence with respect to your use and/or access of that area or feature, unless it is specified otherwise. Laugh Dealer may charge small fees to Clients (collectively, “Service Fees”) in consideration for the use of the Laugh Dealer Services. Any applicable Service Fees (including any applicable Taxes) will be displayed to a Client prior to booking the Services. Laugh Dealer reserves the right to change the Service Fees at any time, and we will provide Clients adequate notice of any fee changes before they become effective. You are responsible for paying Laugh Dealer any Service Fees that you owe. Except as otherwise provided on the Laugh Dealer site, Service Fees are non-refundable. Laugh Dealer confirms receipt of order and contacts User if needed with any questions or concerns. Laugh Dealer also offers a free (optional) 15 minute consultation, which is highly encouraged. Accepting the consultation allows Laugh Dealer to better tailor the jokes to the content. By declining the consultation, User accepts that the final product may not be exactly what they imagined. After booking has been submitted and consultation has been offered and/or completed, your certified Laugh Dealer sends custom jokes designed just for your content, by the date requested. Subject to meeting any requirements (such as completing any verification or expectation management processes) set by the Site, you can book the Services available on the Laugh Dealer Site by following the respective booking process. All applicable fees, including the Joke Writing Fee and any applicable Taxes (collectively, “Total Fees”) will be presented to you prior to booking your Services. You agree to pay the Total Fees for any booking you request on the Laugh Dealer Site. Upon receipt of a booking confirmation from Laugh Dealer, a legally binding agreement is formed between you and the Site. The Laugh Dealer Site will collect the Total Fees at the time of the booking request or upon the Site’s confirmation of the booking. If you book the Laugh Dealer Services on behalf of additional individuals, you are required to ensure that every additional individual meets any requirements set by the Site, and is made aware of and agrees to these Terms and any terms and conditions, rules and restrictions set by the Site. If you are booking for an additional individual who is a minor, you represent and warrant that you are legally authorized to act on behalf of the minor. You understand that a confirmed booking of the Services is a one-time limited license granted to you by the Site to disseminate jokes created by the Site, either verbally, digitally, or in print for your specific project noted on the booking form. The Site retains the rights to these jokes, as well as the right to reuse or repurpose any or all jokes for future bookings. You agree that if any content created by Laugh Dealer creates additional income opportunities for you after the original booking (i.e. using a joke for a t-shirt slogan or branded mug) you will first notify Laugh Dealer and mutually discuss an appropriate referral fee or percentage for any new stream of income. You are solely responsible for compliance with any and all laws, rules, regulations, and Tax obligations that may apply to your use of the Laugh Dealer Service.
