Landry & Jacobs, LLC utilizes an aggressive, investigative approach to commercial debt recovery. Within the first 48 hours of placement, the recovery specialist assigned to the file will investigate all aspects of the debtor company, including ownership structure, company owned assets, possible bankruptcy, UCC filings and all other applicable public records. Should circumstances dictate, Landry & Jacobs, LLC may contract with a licensed Private Investigator in the debtor’s area to conduct an on-site asset investigation or more intensive asset identification at no cost to our client.
If the debtor company does not initiate contact with our offices, the Recovery Specialist will make demand upon the responsible party in a firm, yet professional matter. Armed with a wealth of knowledge about the debtor company, the Specialist can make informed, on the spot decisions about terms of repayment. While demanding the balance in full from the company which clearly does not have the means to make payment is counter productive, accepting liberal repayment terms from a company which has the means to make payment in full is a costly mistake.
In comparison to consumer debt recovery, commercial debt is pursued more aggressively and within more narrow time constraints. Generally, our company will have an informed idea of the direction of each file within the first 72 hours of placement. This is a byproduct of our attention to detail, utilization of cutting edge technology to obtain information quickly and employing experienced Recovery Specialists.
Many companies are sensitive to the amount of pressure placed on their customers, even those placed for collections. We are equipped to handle audit approach collections, in an effort to retain past due customers should our clients request this approach.
Consumer debt recovery is a strictly regulated and governed industry. The standards of the federal Fair Debt Collection Practices Act and Fair Credit Reporting Act provide specific protection and remedy to the consumer.
Each consumer file placed with our office is referred to a Recovery Specialist, who will attempt to recover the funds via a combination of telephone contact and mailings, in accordance with applicable laws. Our philosophy is to give our recovery specialists ownership and accountability on each file as well as allow debtors to build trust and understanding with the collector handling his or her file.
Should circumstances warrant, legal referral will be considered on consumer accounts. The primary factors in this process are balance owed, locality of debtor and most importantly, the likelihood of recovery once judgement is rendered. Legal action will not commence without signed permission from our client on a case by case basis. Our recovery department will only recommend legal action if all other avenues have been exhausted. The unwillingness to pay, as opposed to the inability is generally our gold standard in making this decision. If our client agrees with our agency’s recommendation for legal referral, the file will be forwarded to a networked collection attorney in the appropriate jurisdiction.
