Here’s some of the questions I asked and what he had to say: On the Nonimmigrant and Immigrant side there are basically 4 options. In both types of Visas there is an offer for professionals, which need to have a Bachelor’s Degree or above and an offer from a 3rd party company that is not owned or controlled by the person applying for the visa. The 2nd option is for investors, who have capital to create or invest in a company in the U.S and petition themselves. The 3rd option is for International Managers and Executives which means you work for a company abroad, that has an affiliate company here in the U.S. or just opened one, and you get transferred as a manager, executive, or specialized knowledge employee. The 4th area is extraordinary ability, which a lot of times is used for artists, photographers, and media, and it can also be used in the categories of business. Number 1, make sure that person is an attorney, because what happens in Miami especially is that people masquerade themselves, paralegals or for example, notaries, which in the state of Florida are people who check your IDs and verify who you are, but in Latin America a public notary is kind of like a super lawyer. So Latin Americans in particular will come to Miami and if they are not well positioned, they may end up at a notary or a paralegal who is holding themselves out as an attorney. These people wouldn’t be able to represent the client in any legal aspect. Make sure the attorney you are dealing with specializes in the type of business immigration you need, some attorneys will extend their help to you, however, their speciality is with family immigration. These attorneys won’t know what to do when it comes to any complex visa you may need and will waste your time and money. Ask questions like “How many L-Visas have you ever done?” and “What has been your experience on how much money needs to be invested when they say substantial?” Make sure the attorney explains themselves and the way the visas work and ask the necessary questions to figure out whether or not it is a legitimate. Be aware if they charge a lot of money also and if it is the true market rate or if their level of expertise matches the amount that they are charging. John is a partner at Ainsworth & Clancy. Before graduating from the University of Miami School of Law and joining the Florida Bar, John graduated from Michigan State University in 2005 and subsequently worked in the logistics and automotive industries. In logistics, John gained experience in fleet management and OTR, rail, and LTL shipment sales. He then worked in the automotive industry as a consultant and project manager, helping automotive companies to devise effective strategies in supply chain, marketing, purchasing, production, and other areas.
