During events, using a particular equipment, the company captures the audience of a particular event, producing a huge photo of the crowd, creating a virtual atmosphere, where each person can zoom into the photo in a way that every single person can find themselves inside the stadium, extending the arena experience to an online environment, increasing fan participation.
1. Introduction These Terms, Conditions and Privacy Policy ("Terms") apply to the use of the photograph –Gigaphoto by GIGAFANS, being an interactive panoramic 360-degree photo taken from the crowd at an event, concert, or meeting ("Event").
• "Company, or "us" means GIGAFANS, LLC, registered in Orlando, FL.
• "you" means each person who appears or uses GIGAFANS software.
You acknowledge and agree that you have read and accepted these terms. If you do not agree to these Terms, do not use or browse the GIGAFANS pages.
2. GIGAFOTO By accessing one Gigaphoto (and accepting, therefore, the terms and conditions) you can tag yourself, authorizing the collection of information on social networks by GIGAFANS and its partners. GIGAPHOTOS taken at any Event will generally be uploaded and made available within 24 hours after the event. The Company and/or the promoter and/or partner/sponsor, as the case may remove Gigaphoto from the site at any time without prior notice.
3. Use of GIGAFANS application You are responsible for the use of GIGAFANS and for any content you add. You agree that:
• the use of GIGAFANS website is entirely at your own risk;
• you will not use the content to intimidate, harass or denigrate any person whose image is perceivable in GIGAFANS;
• you will not use GIGAFANS in any way that violates or infringes another person's rights or privacy.
4. Tags/Check-ins GIGAFANS allows you to tag yourself and share it on social networks. Just having and login in through a social network (Facebook, Twitter, and Google Plus) account will allow you to participate. By participating you agree to the Company, the promoter and the sponsor that:
When you tag yourself, a notification with the link to your image in the Gigaphoto will automatically be published to your Facebook timeline. You can then remove yourself from the photo if you no longer want to appear in a Gigaphoto, please contact
[email protected]. Tell us where you are in the Gigaphoto by sending a print screen and we will remove it digitally, just as we can erase and cover your face. Before we do this, we may request that you prove your identification. We will try to remove it from the photo within 5 (five) business days, and give it a link where it is possible to verify that it has been removed from the photograph.
5. How can we use your information? We collect information about you, such as your full name, e-mail address, postal/zip code, mobile number, identification number and other information you may choose to provide us with "Personal Information". The personal data collected will be stored along with your login details to form your GIGAFANS profile. You agree that:
• We may use the information we collect from you to compile non-personally identifiable and/or aggregated statistics about the use of our Gigaphoto products and services and may share such aggregate information with partners;
• We may share your personal data with companies that provide certain services to us for the purpose of providing our services. Such services may include processing information, managing and improving customer data, customer service, evaluating your interest in our products and services, and conducting customer satisfaction surveys or surveys. These companies are required to protect your information in terms of our contracts with them and may be located in different jurisdictions.
6. Privacy Policy We will do our best to ensure that your information is up-to-date and accurate. You may at any time request that your information is corrected in the event of an error. You agree that by virtue of the nature of the tag/check-in, the information you enter in the tag will be disclosed through the GIGAFANS website and, due to the nature of the Internet, the information you enter in it may be transmitted to other countries than the country where are located and may be visible to people around the world. You should also be aware that when you share information publicly, it can be indexable by search engines. You agree not to post personal information such as your phone number, address, email address or other contact information to make it publicly accessible in your tag. We are not responsible for any damages you may suffer as a result of your failure to comply with this company rule. Our servers are located in data centers around the globe, to allow for faster application speed, lower latency, and mitigation. Our operating offices are in Florida and you agree that we may export information from the country where the event took place and or wherever applicable data center may be located.
