ExpressHosting, “The Company”, agrees to provide services to the Subscriber, subject to the following Terms of Service (TOS). We have the responsibility to protect each client and provide them with the best services available. Please read the following guidelines very carefully before ordering our services. Therefore, Subscriber agrees that the Company may disclose any and all subscriber information including assigned IP numbers, account history, account use, etc. to any law enforcement agent who makes a written request without further consent or notification to the Subscriber. In addition the Company shall have the right to terminate all service set forth in this Agreement. The Company reserves the right to alter the Subscribers agreed upon rate from time to time in order to maintain a cost effective rate of service. The Company takes a zero tolerance approach to the sending of Unsolicited Commercial Email (UCE) or SPAM over our network. Very simply this means that customers of may not use or permit others to use our network to transact in UCE. Customers of may not host, or permit hosting of, sites or information that is advertised by UCE from other networks. In addition, it is not acceptable to transmit bulk email through remote SOCKS, HTTP or other similar proxies who in turn make a SMTP (TCP port 25) connection to the destination mail servers. This technique may result in account suspension or termination. Violations of this policy carry severe penalties, including termination of service. Under no circumstances shall the company be responsible for the loss of any customer data from our servers. Possible reasons for loss of data may include external or internal attacks against our servers or network, hardware failure, user error, network failure, forces of nature and administrative error. Customers are responsible for the data on their servers. In the event that a hard drive failure occurs, the company will attempt a best effort to provide access to that data if possible. We encourage each customer to make regular backups of their data. Under no circumstances, including negligence, shall the company (or anyone else involved in administering or distributing the services of the company) be liable for any direct, indirect, incidental, special, or consequential damages that result from the use of (or inability to use) the company’s services; software, including but not limited to reliance on any information obtained, or stored, on the company servers; or that result from mistakes, omissions, interruptions, deletion of files or email, errors, defects, viruses, delays in operation or transmission, or any failure of performance, whether or not limited to acts of god, communications failure, theft, destruction, or unauthorized access to the company’s records, programs, or services. In addition, under no circumstances shall the company be held liable for the errors (defined by us) made by our billing agents.
