Elephant Gun, LLC (EG) warrants, to the original buyer only, that its products are free from defects in material or workmanship. This warranty expires 90 days from the date of delivery. If the buyer discovers within this period a defect in material or workmanship, the buyer must promptly notify EG in writing. In no event may that notification be received by EG later than 180 days from the date of delivery. In case of a defect of material or workmanship covered by this warranty, EG will provide, at its option, one of the following: a replacement product or a full refund of the purchase price. These remedies are the buyer’s only remedies for breach of warranty.
EG does not warrant (a) defects caused by improper installation conditions or other installer related error; (b) damage caused by use of a product for purposes other than those for which it was designed or installation in a dangerous place or manner (for example, obstructing a driver’s view); (c) damage caused by unauthorized attachments or modifications; (d) damage during shipment; or (d) any other abuse or misuse by the buyer.
EXCEPT FOR THE WARRANTY EXPRESSLY SET FORTH ABOVE OR ESTABLISHED BY APPLICABLE LAW AS RIGHTS THAT CANNOT BE WAIVED OR LIMITED BY CONTRACT, ELEPHANT GUN, LLC DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
IN NO EVENT WILL EG BE LIABLE FOR ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES BASED ON BREACH OF WARRANTY, BREACH OF CONTRACT, NEGLIGENCE, STRICT TORT, OR ANY OTHER LEGAL THEORY. DAMAGES THAT EG WILL NOT BE RESPONSIBLE FOR INCLUDE, BUT ARE NOT LIMITED TO: LOSS OF PROFITS; LOSS OF SAVINGS OR REVENUE; LOSS OF USE OF THE PRODUCT OR ANY ASSOCIATED EQUIPMENT; COST OF CAPITAL; COST OF ANY SUBSTITUTE EQUIPMENT, FACILITIES, OR SERVICES; DOWNTIME; THE CLAIMS OF THIRD PARTIES; AND INJURY TO PROPERTY.
Any action for breach of warranty must be commenced within 9 months following delivery of the product.
