We represent insurers / TPA’s investigating insurance claims pre-suit, including retaining experts and conducting examinations under oath to determine the strengths and weaknesses of coverage exclusions as well as the scope and pricing for repairs at issue. We also provide our clients with an “in house counsel solution” that is designed to defend and resolve litigation while significantly reducing your Legal Loss Adjustment Expense. We charge a negotiated flat fee for conducting examinations under oath and litigation services. Because the representation is conducted on a flat fee basis, your attorney's incentive is to get claims resolved expeditiously. We are the lawyers in the trenches determining the appropriate litigation strategy and strength or weaknesses of defenses, communicating with litigation adjusters, retaining experts, taking depositions and conducting mediations. How many times have you had a claim wind up in litigation for years before you find out it’s a claim that should be resolved; that your expert witness testimony won’t stand up well when challenged on cross examination or that the witnesses didn’t testify as well as expected, etc. Knowing the strengths and weaknesses of defenses and the scope and pricing for repairs at issue, at the onset of litigation, gives you the best opportunity to avoid protracted litigation that only serves to drive up attorney’s fees on both sides. Having an “in house counsel” that you trust to provide you with good advice, with no financial incentive to drive up fees and no pressure to posture every case as a good trial candidate, is the most efficient way to resolve claims. In 1988 David graduated from Florida Atlantic University with a degree in accounting and passed the CPA exam. He worked for John P. Barbee, U.S Bankruptcy Trustee, conducting forensic accounting, fraud investigation and business reorganization for entities under Chapter 11. In 1997 David graduated from St. Mary’s University Law School. He has practiced law in Florida for more than 19 years, beginning with the Plaintiff’s personal injury law firm of Montero, Finizio, Velasquez, Weissing & Reyes handling personal injury, wrongful death and product liability claims. David successfully tried to verdict a traumatic brain injury claim as well as other personal injury claims. He also represented Group 1 Automotive, a Fortune 500 automotive retailer, prosecuting breach of contract claims as well as defending consumer claims for violation of Florida’s Deceptive and Unfair Trade Practices Act. For the past nine years David worked for the statewide law firm of Groelle & Salmon, P.A. and was made a partner of the firm for his work defending many of the largest property insurance companies in Florida.
